As Bikers Protest Helmet Laws, Some States Look to Reform

By admin on September 6, 2011

New Hampshire is one of only three U.S. states that do not require motorcyclists of any age to wear helmets when they ride. Illinois and Iowa have similar no-helmet-required rules. In the other 47 states, however, at least some riders are required to wear helmets, and 27 states require all motorcyclists to wear them. In recent years, motorcyclists in several states have begun protesting their state’s helmet laws, leading legislators in several states to consider helmet law reform.

Supporters of motorcycle helmet laws point to statistics from the U.S. Department of Transportation (DOT) and other research groups that predict a motorcyclist increases his or her chances of surviving a serious crash by 37 percent if he or she wears a helmet, and the severity of head injuries also decreases if a motorcyclist wears a helmet, which can lead to quicker recovery and less long-term impairment. Supporters also point to the increase in medical costs and insurance premiums for all those covered, as the health care and insurance systems attempt to compensate for the expensive care required when an uninsured motorcyclist suffers serious head injuries.

Opponents of mandatory helmet laws, however, say that the decision whether or not to wear a helmet is a choice that ought to be left to each individual motorcyclist as a matter of personal freedom. They note that bikers who choose not to wear helmets can purchase additional insurance to cover their increased risks on the road, which makes the costs the biker’s responsibility instead of society’s. Michigan is considering a change that would require motorcyclists who don’t wear helmets to pay for insurance coverage of at least $100,000 in case of injury.

Protective gear is a wise choice, but it can’t make other drivers respect your right to share the road. If you’ve been injured in a motorcycle accident, the experienced NH motorcycle accident attorneys at Tenn And Tenn, P.A. can help. Center Harbor Motorcyclist Injured in Crash

By admin on August 29, 2011

A Center Harbor man suffered injuries when his motorcycle was hit from behind on Route 4 recently, according to an article in the Sun-Journal.

Police are still investigating the crash, but they say that it appears the motorcyclist was slowing down near the intersection of Route 4 and Route 17 when he was hit from behind by a van driven by an elderly Sumner resident. The van pushed the motorcycle into the southbound lane, causing it to spin out of control. Its rider slid across the hood of the van and fell into the southbound lane, where he rolled as much as forty feet before coming to a stop, according to investigators.

The motorcyclist was taken to a local hospital, where he was recently said to be in good condition. He is expected to recover from his injuries. Investigators did not say whether or not the driver of the van was injured. The motorcyclist was wearing a helmet at the time of the crash, but it may have come off immediately after he was hit, according to police.

Nashua Motorcyclist Injured in Crash

By admin on August 15, 2011

A motorcyclist suffered serious injuries and had to be airlifted to a local hospital after he was hit by a 96-year-old driver, according to a recent article in the Nashua Telegraph. The accident occurred at the intersection of Daniel Webster Highway and Veterans Drive.

The driver of the car involved in the accident told police that she couldn’t see the light because of a large truck in front of her, but when the truck and the car to her left decided to drive through the light, she did too, realizing too late that the light was red. Her car struck an SUV traveling through the intersection, then struck the motorcyclist. The SUV driver was not injured. The motorcyclist was taken too Massachusetts General Hospital, where he is in fair condition and is expected to recover from his injuries.

Based on the driver’s and eyewitness’s comments, Nashua police believe that the driver’s decision to drive into the intersection despite the red light caused the crash, and that neither alcohol nor drugs were involved. However, police are investigating the accident more closely.

Because of their exposure to the road, motorcyclists face a higher risk of injury in a crash. New Hampshire Motorcycle Accident Leaves Stoneham Resident Injured

By admin on July 22, 2011

A motorcyclist from Stoneham, New Hampshire suffered critical injuries recently when a motorist failed to yield the right of way at a Candia intersection, causing a crash. The biker was attempting to pass through the intersection of Old Candia Road and Adams Road on a weekend afternoon when the accident occurred.

A car trying to make a left turn onto Old Candia Road did not stop to let the motorcycle clear the intersection. Instead, the vehicle collided with the motorcycle as it turned left, causing serious injury to its rider. The motorcyclist was rushed to Massachusetts General Hospital, where he was last reported as being in critical condition.

The driver of the car, a Londonderry resident, was not injured. Police are still investigating the crash and have not said whether the car’s driver will receive a ticket or face stricter criminal charges.

Failing to yield the right of way occurs when a driver doesn’t slow down or stop at an intersection to allow another driver to travel safely through the intersection when they have a green light, or reached the intersection first. The mistake may be due to distraction, to a lack of familiarity with the intersection, or due to willful ignorance or a desire to “beat” the other driver. Whatever the cause, however, failing to yield the right of way can result in serious injuries, especially when the resulting crash involves a motorcycle.

Study Shows Motorcycle Accidents Declined in 2010

By admin on May 10, 2011

The number of fatal motorcycle accidents that occurred on U.S. roads in 2010 is two percent lower than the number of accidents that occurred in 2009, according to a report issued by the Governors’ Highway Safety Association (GHSA). The report studied the rates of motorcycle accidents in all fifty U.S. states as well as the District of Columbia.

According to the report, 4,465 motorcycle accidents resulted in a death in 2009. In 2010, however, that number dropped to 4,373 deaths. The decrease is part of a trend that began in 2009; the number of lives lost in motorcycle accidents in 2009 was sixteen percent lower than the number of lives lost in 2008.

The trend of fewer motorcyclists losing their lives in accidents is encouraging. However, the study also revealed several facts that motorcyclists should consider when they ride. First, although the number of deaths decreased overall, the last three months of 2010 had more accidents than the end of 2009, which may be partially due to drivers who are distracted by weather or holiday festivities and are not as vigilant for bikers as they would normally be. Also, the number of motorcyclists who wear helmets dropped dramatically in 2010.

Alton Motorcyclist Sustains Serious Injuries in Route 28 Crash

By admin on April 18, 2011

A motorcycle rider in Alton lost control of his motorcycle recently and crashed, according to a news report from WMUR. He was traveling down Route 28 on a weekday afternoon when his motorcycle crashed into a roadside ditch. Rescue workers extracted the motorcyclist from the ditch and he was transferred by helicopter to Lebanon’s Dartmouth-Hitchcock Medical Center, where he is being treated for serious injuries. Local police are attempting to determine what caused the motorcycle to crash. According to police, the crash marks the first motorcycle accident that has occurred in Alton this year.

According to the National Highway Traffic Safety Administration (NHTSA) dozens of New Hampshire motorcyclists lose their lives in motorcycle crashes each year. While the number of fatal New Hampshire motorcycle accidents has stayed low in most recent years, 2005 was a particularly dangerous year in which 41 motorcyclists fatalities occurred. In addition, dozens of motorcycle riders suffer injuries on New Hampshire roads each year when they are involved in traffic accidents.

If you have been injured in a motorcycle accident, you have certain rights under New Hampshire law. Benefit Held for New Hampshire Trooper Injured in Motorcycle Accident

By admin on January 26, 2011

Friends and supporters of New Hampshire state trooper Tom Bolton held a fundraising benefit on his behalf on January 15, according to an article published in The Nashua Telegraph. ESPN/WGAM sports radio host Jim Censabella led the fundraiser’s events, which included live music, raffles, and auctions.

Trooper Tom Bolton was recently injured in a serious motorcycle accident. Although he is out of the hospital, his physicians have recommended additional spinal rehabilitation therapy. Bolton’s friends and supporters arranged the fundraiser to raise the money for Bolton’s therapy needs.

New Hampshire motorcycle accidents can cause serious injury, including traumatic brain injuries and spinal cord injuries. These injuries often have serious consequences, including loss of brain functions, paralysis, or loss of the ability to control movement. Treatment for these injuries can be expensive, and even the best treatment cannot always restore a person to a fully functional, pain-free life.

Most motorcyclists drive carefully, keeping in mind the risks of the road. Unfortunately, drivers of cars, trucks and other vehicles that share the road with motorcycles don’t always understand these risks. A driver’s failure to watch for motorcycles or to provide adequate space for a motorcycle to maneuver can result in serious injury or even death for those on motorcycles.

If you or someone you love has been injured in a New Hampshire motorcycle accident, please call the experienced New Hampshire motorcycle accident lawyers at Tenn And Tenn, P.A. We will examine your case carefully and help you understand your legal rights and options. To schedule a free and confidential consultation, call Tenn And Tenn, P.A. today at 1-888-511-1010.

Motorcycle Safety Gear Can Help Riders Avoid Serious Injury

By admin on December 16, 2010

Drivers of cars, trucks, and other motor vehicles should always be on the lookout for motorcycles. Unfortunately, motorists don’t always notice bikes on the road until it’s too late to avoid a collision. However, if a motorcyclist chooses the right motorcycle safety gear, it can prevent an accident from turning into a tragedy, according to the Motorcycle Industry Council.

To help protect yourself in the event of a motorcycle crash, consider using the following safety gear:

  • Motorcycle helmets. New Hampshire is one of only three states in the U.S. without a motorcycle helmet law, but that doesn’t mean you should overlook this valuable piece of safety equipment. Choose a full-face helmet or wear separate eye protection to keep bugs and debris out of your eyes.
  • Leather or armored jackets. Both types of motorcycle jackets offer some protection from road rash if you skid across the pavement in a New Hampshire motorcycle crash.
  • Pants. Full-length leather or armored pants not only protect you in an accident, they also keep your legs from being burned on hot motorcycle engine parts and protect you from rocks that may fly up from the road while you ride.
  • Boots. A sturdy pair of leather boots can help prevent you from dislocating an ankle or suffering other leg injuries in a crash.

You can’t always prevent a motorcycle accident in New Hampshire from occurring, but motorcycle safety gear can help protect you from suffering severe injury or death. If you need help after a motorcycle accident, please don’t hesitate to call the experienced New Hampshire motorcycle accident lawyers at Tenn And Tenn, P.A. National Transportation Safety Board Wants 50-State Helmet Laws

By admin on December 8, 2010

Due to the increase in motorcycle-related injuries and deaths since the late 1990s, the National Transportation Safety Board (NTSB) is now pushing for laws that require riders to wear helmets in all fifty U.S. states, reports The Concord Monitor.

Although the number of other transportation accidents has gone down in the last decade, the number of accidents involving motorcycles has gone up, according to the NTSB. The number of transportation accidents overall has also gone up, as the increase in motorcycle accidents more than made up for the decrease in train, plane, and boat crashes.

According to the NTSB, the most common cause of death in a motorcycle accident is head injury. The NTSB estimates that thousands of lives could be saved if all fifty states required motorcycle riders to wear helmets. Compared to other countries, transportation fatality rate in the U.S. is quite high, in part because motorcycle riders may choose in most states whether or not to wear helmets. Currently, only 20 states in the U.S. require all riders to wear helmets. Several other states only require helmets for certain riders or in certain situations. New Hampshire, along with Iowa and Illinois, does not have a motorcycle helmet requirement.

Wearing a motorcycle helmet is a smart move for all motorcyclists. Unfortunately however, a helmet may not prevent every injury if a careless or negligent driver collides with your bike. If you have been injured in a motorcycle accident in New Hampshire, you have certain legal rights. The experienced New Hampshire motorcycle accident attorneys at Tenn And Tenn, P.A. can help you understand your rights and options, and we will fight hard to win you the compensation you deserve. Speed Led to Manchester Motorcycle Injury Crash

By admin on October 12, 2010

A Manchester resident was seriously injured in a New Hampshire motorcycle crash recently, according to an article published in the Union-Leader. He was traveling at a high rate of speed when he crashed at the corner of Laxon Avenue and Eduardo Street. It appears he was trying to elude police officers when he crashed.

Officers appeared at the scene almost immediately after the motorcycle driver crashed and called emergency services, which transported the man to a local hospital to receive treatment for the serious injuries sustained in the New Hampshire motorcycle accident. Police officers reported that speed was a factor in the crash, but did not say whether intoxication or road conditions played a role in the motorcycle accident.

Traveling in urban areas at high speeds is never safe, and it is especially dangerous for motorcyclists. Motorcycle riders are less protected than motorists in cars. Motorcycle riders can help protect themselves from accidents by obeying posted speed limits. Drivers of cars and trucks can also help prevent serious motor vehicle collisions by following speed limits and by staying a safe distance away from motorcycle riders. This will allow a vehicle the distance it needs to stop in time if the motorcyclist should fall or crash.
